The Legal Side (and What We Actually Handle)
California sets specific rules for reclaiming an abandoned commercial property. Under Civil Code § 1951.35, a landlord can serve a Notice of Belief of Abandonment once rent has been unpaid for at least 3 days (or the lease’s default period, whichever is longer). The tenant then has 15 days to respond before the lease is legally deemed terminated.
Once that window closes, personal property valued under $750, or $1 per square foot of the space, whichever is less, can be disposed of without further formal process.
